1. Introduction

These Terms of Use govern the use of the Quardy mobile application, published by:

2. Purpose of the application

Quardy is a mobile loyalty card management application offering two modes of use:

• User: collect and manage your digital loyalty cards from various merchants
• Merchant: create and manage a loyalty programme for your customers

A single account can be used as both a user and a merchant simultaneously.

3. Acceptance of terms

Using the Quardy application implies full and complete acceptance of these Terms of Use. If you do not accept these terms, please do not use the application.

4. Registration and user account

4.1 Account creation

To use Quardy, you must create an account by providing:

• Your first and last name
• A valid email address
• An authentication method (Apple, Google or email/password)

4.2 Accuracy of information

You agree to provide accurate information and to keep it up to date. The use of false information may result in the suspension of your account.

4.3 Account security

You are responsible for the confidentiality of your login credentials. Any activity carried out from your account is deemed to have been carried out by you.

5. Use of the service - Users

5.1 Loyalty cards

As a user, you can:

• Join loyalty programmes of participating merchants
• Accumulate points, stamps or cashback depending on the programme type
• Check your balance and history
• Present your card (QR code) to merchants
• Delete your loyalty cards at any time

5.2 Marketing communications

When joining a loyalty programme, you can choose to accept or decline marketing communications from the merchant. This choice can be changed at any time.

6. Use of the service - Merchants

6.1 Creating a business

Merchants can create a loyalty programme by defining:

• The name and description of the business
• The loyalty type (stamps, points or cashback)
• The reward rules
• The card appearance

6.2 Free quota

Each business has a free quota of 50 active customer cards. Beyond this limit, a premium subscription is required.

6.3 Customer management

Merchants can:

• View their list of loyal customers
• Add or remove points/stamps/cashback
• View operation history
• Scan customer QR codes

6.4 Merchant obligations

Merchants agree to:

• Respect the rules of their loyalty programme
• Not use customer data for purposes other than managing the loyalty programme
• Respect customers' choices regarding marketing communications
• Not share customer data with third parties

7. Premium Subscription (Merchants)

7.1 Premium features

The premium subscription allows merchants to exceed the 50 active customer card quota and access advanced features.

7.2 Pricing

The subscription price is displayed in the application at the time of subscription. The subscription is monthly with automatic renewal.

7.3 Payment and management

Payment is managed by Stripe, a secure payment provider. Subscription and management are handled through a dedicated web interface accessible from the application.

We do not store any of your banking information. Payment data is processed directly by Stripe.

7.4 Cancellation

You can cancel your subscription at any time from the management portal accessible in the application settings. Cancellation takes effect at the end of the current period.

8. Personal data

The collection and processing of personal data are described in our Privacy Policy.

For their customers' data, the merchant is the controller and Quardy acts as processor, under the terms of the Data Processing Agreement (DPA), which forms part of these terms.

9. Prohibited conduct

The following are prohibited:

• Creating fake accounts or impersonating others
• Fraudulently manipulating points, stamps or cashback
• Attempting to circumvent security measures
• Using the application for illegal purposes
• Collecting other users' data without authorisation
• Disrupting the operation of the service

10. Intellectual property

The Quardy application, its source code, design, texts, images and all elements that compose it are protected by copyright and belong to Damien Buchet. Any unauthorised reproduction is prohibited.

11. Liability

11.1 Publisher's liability

We strive to keep the service available and functional. However, we cannot guarantee permanent availability and shall not be held liable for:

• Temporary service interruptions
• Disputes between customers and merchants
• A merchant's failure to honour their loyalty programme
• Loss of data in case of account deletion

11.2 User liability

Users are responsible for:

• The accuracy of the information provided
• The security of their account
• Compliance with these Terms of Use

12. Account deletion

You can delete your account at any time from the application settings. Deletion results in:

• For users: the deletion of all your loyalty cards and your history
• For merchants: the deletion of your business and all associated customer cards

This action is irreversible.

13. Changes to the Terms of Use

We reserve the right to modify these Terms of Use. Any significant change will be notified via the application. Your continued use of the service after modification constitutes acceptance of the new terms.

14. Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period with the consumer's agreement.

15. Applicable law and disputes

These Terms of Use are governed by French law. In case of dispute, an amicable solution will be sought before any legal action. Failing that, French courts shall have jurisdiction.
